BODY SCULPTING AUSTRALIA TERMS AND CONDITIONS

Website Terms & Conditions

Last updated: 12 October 2026

1. Introduction

Welcome to Body Sculpting Australia (BSA).

These Terms & Conditions govern the use of our website, appointment bookings, treatment purchases and services provided by Body Sculpting Australia, operated by Minoba Pty Ltd.

By accessing or using our website, you agree to the terms applicable to website use. When booking or purchasing treatments, the relevant service terms apply where they have been made available to you before your booking or purchase and form part of your agreement with us.

These Terms & Conditions should be read together with our Refund, Cancellation & Booking Policy and Privacy Policy.

Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law (ACL) or other applicable Australian and Victorian legislation.

2. Our Services

Body Sculpting Australia provides non-surgical body contouring, body sculpting, skin tightening, toning and related aesthetic treatments.

Treatment suitability, recommended procedures and expected outcomes vary according to individual circumstances.

All treatments are subject to an appropriate consultation, assessment and any required informed consent.

We reserve the right to decline, postpone or modify a treatment where reasonably necessary for client safety, professional standards or other legitimate reasons.

Where we cannot provide a purchased treatment, we will offer an appropriate alternative or refund in accordance with our Refund, Cancellation & Booking Policy and applicable consumer law.

3. Prepaid Treatment Packages

3.1 Standard Package Validity

Standard prepaid treatment packages are valid for 12 months from the date of purchase, unless a longer period is required by law or expressly agreed in writing.

Clients should book and complete their treatments within the stated validity period.

We will clearly disclose the applicable expiry date or validity period before purchase.

Where a package expires with unused sessions, those sessions will generally no longer be available for redemption, provided the expiry condition is lawful, fair, clearly disclosed and enforceable.

We will reasonably consider extension requests involving illness, medical contraindications, pregnancy, exceptional circumstances or situations where BSA has been unable to provide the purchased services.

Expiry conditions do not limit any statutory rights or remedies.

3.2 Payment

Unless otherwise agreed, prepaid packages must be paid in full before the first treatment.

Any alternative payment arrangement must be confirmed by BSA.

3.3 Transfers

Treatment packages are purchased for the named client and are generally non-transferable.

Transfers may be considered upon request, subject to treatment suitability, any applicable legal requirements and BSA’s reasonable approval.

Any applicable transfer fee must be reasonable and disclosed before the client agrees to the transfer.

3.4 Standard Package Refunds

Clients purchasing standard treatment packages may request a full change-of-mind refund before their first treatment begins.

Once treatment has commenced, refunds for change of mind are not generally available.

Any separate, lawful and reasonable appointment cancellation fee may apply where clearly disclosed before booking.

These conditions do not affect rights under Australian Consumer Law.

4. Promotional Packages & Special Offers

Promotional packages may include discounted treatments, seasonal campaigns, limited-time offers and specially priced treatment combinations.

4.1 Promotional Validity

Promotional treatment packages purchased directly from BSA are generally valid for 3 months from the date of purchase, where this period is lawful and clearly disclosed before purchase.

Clients should complete the included treatments within this period.

Where a promotion is subject to gift card legislation or another mandatory legal requirement, the legally required validity period will apply instead.

4.2 Change-of-Mind Refunds

Promotional and discounted treatment packages are generally non-refundable for change of mind, including before treatment has commenced, where this condition was clearly disclosed before purchase and is otherwise lawful.

This does not affect any statutory entitlement to a refund or other remedy.

4.3 Promotional Conditions

Unless expressly stated otherwise, promotional offers cannot be combined with other discounts, promotions or special offers.

Additional offer-specific conditions, including booking restrictions, treatment inclusions and expiry dates, will be disclosed before purchase.

BSA will not retrospectively change the agreed conditions of an existing purchase in a way that unlawfully disadvantages the client.

5. Gift Cards, Vouchers & Third-Party Offers

Gift cards and vouchers are subject to applicable Australian Consumer Law requirements.

Gift cards covered by the statutory minimum validity rules will remain redeemable for at least three years from the date of supply.

Certain vouchers, including those supplied at a genuine discount or under an eligible promotional arrangement, may be exempt from the three-year minimum.

The applicable expiry date and material redemption conditions will be clearly disclosed.

Any fees relating to gift cards will comply with applicable restrictions on post-supply fees.

Vouchers purchased through third-party providers may also be subject to the provider’s disclosed terms, provided those terms comply with applicable law.

Nothing in a third-party agreement limits statutory consumer rights.

6. Appointment Bookings & Deposits

Appointments may be booked online, by telephone or directly with our clinic.

A deposit may be required to secure an appointment. The amount will be disclosed before booking confirmation.

Deposits are generally credited towards the cost of the booked treatment.

Any retention or deduction of a deposit following cancellation must comply with our Refund, Cancellation & Booking Policy and applicable law.

Clients are encouraged to arrive on time.

Where a client arrives late, the appointment may need to be shortened or rescheduled, depending on availability and treatment requirements.

We will act reasonably in determining any applicable charges or adjustments.

7. Appointment Cancellations & Rescheduling

We require at least 48 hours’ notice to cancel or reschedule an appointment without a cancellation fee.

Where less than 48 hours’ notice is provided, or where a client does not attend an appointment, a reasonable cancellation fee of up to $50 may apply.

Any such fee must be consistent with the conditions disclosed before booking and reasonably reflect the clinic’s legitimate costs or losses.

A prepaid treatment session will not automatically be forfeited solely because of a late cancellation or missed appointment.

We will consider exceptional circumstances, including illness and emergencies, fairly.

No cancellation fee will be applied where doing so would be inconsistent with Australian Consumer Law.

Further details are provided in our Refund, Cancellation & Booking Policy.

8. Treatment Consultation & Medical Disclosure

Clients are required to complete relevant consultation and consent documentation before receiving treatment.

Clients must provide accurate and relevant information about their medical history, medications, health conditions, pregnancy status and other circumstances that may affect treatment suitability.

Clients should inform BSA of relevant changes before subsequent appointments.

BSA may recommend postponing or modifying a treatment where reasonably necessary for safety.

Clients are responsible for providing information to the best of their knowledge.

However, nothing in these Terms & Conditions excludes BSA’s responsibility to exercise due care and skill or comply with applicable legal obligations.

9. Treatment Results & Expectations

Non-surgical body contouring results vary between individuals.

Treatment outcomes may depend on body composition, individual physiology, lifestyle, treatment selection and other relevant factors.

BSA does not guarantee a specific aesthetic outcome unless an express guarantee has been made.

Additional treatments may be recommended depending on individual goals and responses.

Any additional treatment costs will be explained before the client agrees to proceed.

The absence of a client’s desired aesthetic result does not automatically establish a failure to meet consumer guarantees.

However, clients retain their legal rights where a service does not comply with applicable consumer guarantees, including where relevant representations or express guarantees have not been met.

10. Refunds & Australian Consumer Law

All treatments and services are provided subject to Australian Consumer Law.

Our services come with consumer guarantees that cannot be excluded, including guarantees relating to due care and skill, fitness for a disclosed purpose where applicable, and supply within a reasonable time where no timeframe has been agreed.

If a service fails to meet an applicable consumer guarantee, clients may be entitled to an appropriate remedy, depending on the circumstances.

For a major failure, this may include cancellation of the affected service contract, a refund or other remedies available under law.

For a non-major failure that can be remedied, BSA may have an opportunity to remedy the issue within a reasonable time.

Change-of-mind refunds are governed by our Refund, Cancellation & Booking Policy, subject to applicable statutory rights.

Nothing in these Terms & Conditions limits any non-excludable consumer guarantee.

11. Before-and-After Photography

BSA may take before-and-after photographs for consultation, treatment assessment, progress monitoring and clinical record-keeping, where appropriate and with the required consent.

Clinical photographs are managed in accordance with our Privacy Policy and applicable privacy and health records legislation.

The use of client photographs for advertising, social media, website galleries, testimonials or other promotional purposes requires separate, voluntary and informed consent.

Clients may decline promotional photography consent without affecting their eligibility to receive treatments.

Where photographs are authorised for publication, BSA may use pseudonyms or generic identifiers to help protect client privacy.

Client photographs and reviews may feature different individuals. BSA will not knowingly present them in a way that falsely suggests they belong to the same person.

Clients may withdraw consent for future promotional use. BSA will take reasonable steps to discontinue such use and remove content from platforms under its control, where applicable.

Any publication remains subject to applicable privacy, advertising and consumer protection requirements.

12. Client Conduct & Clinic Safety

We aim to maintain a safe, respectful and professional environment for clients and staff.

Clients are expected to treat staff and other clients respectfully and follow reasonable safety instructions.

BSA may refuse or discontinue services in circumstances involving threatening, abusive, unsafe or seriously inappropriate conduct.

Where services are discontinued, any applicable refund or other remedy will be determined fairly, considering services already provided, the circumstances and applicable law.

13. Memberships

BSA membership programs, including ShapeUp Club, are governed by separate Membership Terms & Conditions provided before enrolment.

Membership payments, minimum commitment periods, included benefits and cancellation arrangements are addressed in those separate terms.

Membership conditions remain subject to Australian Consumer Law.

14. Website Information

Information provided on this website is intended to describe our services and provide general information about non-surgical body contouring.

Website content does not replace an individual consultation or personalised assessment.

We make reasonable efforts to ensure information is accurate and current.

Images, treatment descriptions and examples of results must not be interpreted as guarantees of individual outcomes.

We may update website information from time to time, but changes will not retrospectively remove contractual or statutory rights.

15. Privacy & Personal Information

BSA collects, uses, stores and discloses personal information in accordance with its Privacy Policy and applicable Australian privacy and health records legislation.

Personal and health information may be collected where reasonably necessary for consultation, treatment provision, booking administration and related lawful purposes.

Clients can review our Privacy Policy for further information about access, correction, data handling and privacy complaints.

16. Limitation of Liability

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, statutory remedy or other right that cannot lawfully be excluded.

To the extent permitted by law, BSA is not responsible for losses that are not legally attributable to a breach of its obligations.

This provision does not exclude liability for negligence, failure to exercise due care and skill, misleading conduct or any other liability that cannot lawfully be excluded.

17. Changes to Terms & Conditions

BSA may update these Terms & Conditions from time to time.

The latest version will be available on our website.

Changes will generally apply prospectively and will not retrospectively remove rights or benefits already agreed to.

Any proposed variation to an existing service agreement will be handled in accordance with the contract and applicable law.

18. Governing Law

These Terms & Conditions are governed by the applicable laws of Victoria and the Commonwealth of Australia.

Nothing in this clause restricts any rights or protections available under mandatory consumer legislation.
